<br /> <br /> <br /> <br /> <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br /> <br />June 15, 2016 <br /> <br />Tim Carper <br />42538 CR 9 <br />Haxtun, CO 80731 <br /> <br />Re: Technical Revision Adequacy Review; Carper Pit #2; Permit No. M-2008-072; TR-01 <br /> <br />Dear Mr. Carper, <br /> <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the request for a <br />Technical Revision (TR-01) for the Carper Pit #2, File No. M-2008-072, and submits the following comments. <br />The Division is required to make an approval or denial decision no later than July 4, 2016; therefore, a <br />response to the following adequacy review concerns should be submitted to the Division as soon as possible. <br />In order to allow the Division adequate time to review your responses to any adequacy issues, please submit your <br />adequacy responses to the Division no later than June 29, 2016. <br /> <br />The review consisted of comparing the Technical Revision content with specific requirements of Rules 1, 3, 6.1, <br />6.2, and 6.4 of the Minerals Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials. Any inadequacies are identified below. <br /> <br />Summary of Technical Revision TR-01 <br /> <br />The Operator has requested to create an additional tract (known as “2.0 Acre Tract”) within Tract 5, revising the <br />shape and size of Tract 5. The new tract will be 2 acres in size, with dimension 315’ x 276’, and is located in the <br />northeast portion of Tract 5. If the intent of TR-01 is different than summarized, please clarify for the Division. <br /> <br />Mining Plan Map <br /> <br />1. The updated Mining Plan Map submitted shows that Tract 5 is still 8.1 acres. The Division understands <br />that this should be changed to 6.1 acres to reflect the addition of the new “2.0 Acre Tract”. Please revise <br />this map. <br /> <br />2. The Division recommends the Operator to identify the new “2.0 Acre Tract” consistently with the other <br />tracts. Identifying it by Tract 8 or revising Tract 5 into Tract 5 and Tract 5A or Tract 5A and Tract 5B is <br />appropriate. <br /> <br />Additional Information <br /> <br />Though not required through the Technical Revision process, the Operator has also notified the Division on the <br />intent to mine this new “2.0 Acre Tract”. The Division will evaluate the reclamation cost estimate provided in the <br />revision, calculate the additional reclamation cost estimate if necessary, and issue a Surety Increase. Once the TR- <br />01 is approved and the additional Financial Warranty is submitted and accepted by the Division, the Operator will <br />receive a letter stating that the Financial Warranty currently held for the site covers the cost to reclaim Tract 2 and <br />the 2.0 acre Tract. <br /> <br /> <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http://mining.state.co.us <br />John W.
