DNR COLORADO
Co 1r Division of Water Resources
Department of Natural Resources
1313 Sherman Street, Room 821
Denver, CO 80203
Response to Reclamation Permit Amendment Application Consideration
DATE: June 2, 2016
TO: Peter S. Hays, Environmental Protection Specialist RECEIVE
CC: Division 1 Office, District 5 ft 6 Water Commissioners 'JUN 0 2 2016
FROM: Sarah Brucker, P.EL/ 5 DIVISION OF RECLAMATIC
RE: Distel Pit, File No. M-1989-029 MINING AND SAFETY
Applicant/Operator: Aggregate Industries - WCR, Inc.
Contact: Connie N. Davis, (970) 396-5252
Sections 7, 8, 17 Et 18, Twp 2 North, Rng 68 West, 6th P.M., Weld County
COMMENTS: The Applicant has filed an amendment application for the Distel Pit to revise the existing
reclamation plan in response to impacts from the September 2013 flooding. The Distel Pit consists of 712
permitted acres along St. Vrain Creek near Longmont, Colorado. As a result of the flood, the size and location
of pond/open water and wetland features have changed from what was proposed in the currently approved
reclamation plan. The currently approved reclamation plan includes approximately 30 acres of wetlands and
60 acres of ponds. During the 2013 flood event, St. Vrain Creek breached its channel north of the pit and
began flowing south of its original channel, through the majority of the pit. Post-flood mapping showed
approximately 78.8 acres of wetlands and 13.0 acres of open water. Aggregate is working with the City of
Longmont to perform additional post-flood restoration and improvements.
The City of Longmont has assumed the augmentation responsibilities for lagged and future depletions from
evaporation from open water surface areas and consumptive use by wetlands vegetation at the Distel Pit site
under their plan for augmentation decreed in case no. 2009CW271. The plan for augmentation projected that
the site would contain 64.0 acres of free water surface area (ponds and streams) and 63.7 acres of new
wetlands after reclamation; however, the augmentation plan will replace actual out-of-priority depletions from
the actual surveyed areas of free water surface and new wetlands at the site post-reclamation. Changing the
location and/or amounts of open water surface and new wetlands areas that will remain at the Distel Pit site
after reclamation will not impact the validity of the existing decreed augmentation plan.
Based on the above, this office has no objection to the proposed amendment application.
The Applicant may contact the State Engineer's Office with any questions.
47/ 1; 901
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water.state.co.us j e.1a
J
N4`,/£477 6,
