Hickenlooper, Governor | Mike King, Executive Director | Virginia Brannon, Director <br />May 18, 2016 <br /> <br />Jim Helmericks <br />Glacier Gravel Products <br />995 Hwy 3 <br />Durango, CO 81301 <br /> <br />Re: J & J Pit, Permit No. M-1985-001, Response to Correspondence <br /> <br />Dear Mr. Helmericks, <br /> <br />On May 18, 2016 the Division received an email correspondence from you indicating the desire <br />for the Division to reconsider its position in regards to the amended surety increase (SI-02) <br />issued on April 12, 2016. <br /> <br />SI-02 was originally issued on February 19, 2016 followed by a request to reconsider from you <br />received by the Division on March 17, 2016. The Division did reconsider and modified the seed <br />mix and removed the task for the scale house disposal per your concerns. As stated in the letter <br />issued with SI-02 on April 12, 2016, after reviewing the original permit file the Division did not <br />revise the tasks that call for regrading the slopes to no steeper than 2H: 1V. Documents <br />supporting this decision were included in the notice. <br /> <br />You have indicated that the original permit was approved for 1H:1V or 1/2H:1V slopes and an <br />industrial commercial site in the original permit. Further review of the permit file and our <br />records indicates that “1:1 slopes would not be recommended for approval to the Mined Land <br />Reclamation Board”. The file indicates the floor of the pit is to be reclaimed as commercial/ <br />industrial and the slopes to wildlife habitat. If you wish us to further reconsider this item, <br />please submit a narrative and documentation showing explicitly where the approval of the <br />slopes in question by the Board was done no later than June 15, 2016. <br /> <br />The Division has also previously indicated that an Amendment or Technical Revision could be <br />submitted to clarify the post mining land use and / or the slope issue and steeper than 2H: 1V <br />slopes would be considered provided a geo-technical stability report was submitted along with it. <br />You have elected not to change the permit therefore the position of the Division unfortunately <br />remains unchanged. However, the Division offer still stands to review and modify your mining <br />and reclamation plans through the Amendment or Technical Revision process as communicated. <br /> <br />All documentation should be directed to Lucas West at the Division’s Denver office at 1313 <br />Sherman Street, Room 215, Denver, CO 80203. <br />
