Pirieda <br />Director <br />Re: Poly Mann Pit, Adams County; Permit No. M-1986-079; Technical Revision TR -8 Denial <br />Dear Ms. Johnson: <br />On 15 March 2010 the Division of Reclamation, Mining and Safety (Division) received the Technical Revision <br />TR -8 submitted by Lafarge North America, Inc. (Lafarge) for the Poly Mann Pit. The Division has reviewed the <br />submittal and in our judgment the revision is substantial enough as to meet the definition of an Amendment <br />under Rule 1.1(6) of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for the <br />Extraction of Construction Materials. <br />Therefore, the Division has denied the TR, and Lafarge must resubmit the application as an Amendment in <br />accordance with Rule 1.10 governing submission of Amendments to a permit. Operator is advised that, <br />according to Rule 1.10.1(4), the Amendment is to be reviewed by the Division in the same manner as an <br />application for a new Permit, the procedures for which are described in Rule 1.4.1 for General Provisions, Rule <br />1.4.5 for 112 Permit Applications, and Rule 1.6 for Public Notice. Be advised that the Division's decision date, <br />assuming no public objections to the filing, will be 90 days from the date the Application is designated as <br />complete for filing purposes. <br />The fee for an Amendment to a 112(c) Construction Materials operation is $2,229.
