The Division understands you recently purchased a 15,000 gallon, <br />self-contained, double wall fuel storage tank. The proposed short-term plan is to have the tank pressure checked, <br />certified, and placed in a temporary location at your Cañon City quarry to be used for off-road diesel fuel storage. <br />We also understand your long-term plan is to construct a permanent fuel storage and dispensing facility which <br />would consist of the aforementioned 15K gallon tank, one (1) 7.5K – 10K gallon double wall on-road diesel <br />tank , one (1) 500 – 1,000 gallon double wall unleaded tank, and provisions for a 1,000 gallon waste oil storage <br />tank. This facility would be constructed using engineered concrete structures & slabs, proper safety curbs and/or <br />bollards, etc. <br />The Division offers the following guidance in response to your questions regarding onsite fuel storage: <br />(1) What, if any, do we need to do from the Division’s stand point, to allow us to utilize the recently <br />purchased tank in a temporary state as explained above? <br />Response: For temporary use of a double-walled fuel tank which is considered to be portable, the <br />written notice you provided in your January 4, 2016 letter is sufficient as it does not require an <br />adjustment to your financial warranty and the double wall meets the requirements for secondary <br />containment assuming it meets the requirements of 40 CFR 112.7(c). <br /> <br />The Division also reminds the Operator that pursuant to Rule 3.1.13 of the Mineral Rules and <br />Regulations of The Colorado Mined Land Reclamation Board for the Extraction of Construction <br />Materials, “The Mine Operator shall Notify the Office of a spill of any toxic or hazardous <br />substance, including spills of petroleum products, that occurs within the mined land permit area <br />and which would be required to be reported to any Division of the Colorado Department of Public <br />Health and the Environment, the National Response Center, the Colorado Emergency Planning <br />Commission, any local Emergency Planning Commission, local Emergency Planning Committee, <br />or the State Oil Inspector”. <br /> <br />(2) With the long term plan in mind, can we submit the addition of the fuel storage facility under a <br />Technical Revision once we have a drawing of the facility with the engineered values and we are ready <br />to begin construction?
