Cunningham, Environmental Protection Special <br />Colorado Division of Reclamation Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: City of Golden, Empire Pit No. M-1977-531-SL01 <br />Notice of 112c Construction Materials <br />;/Reclamation Permit Release Request Consideration <br />Dear Mr. Cunningham, <br />We, the Guanella Family, owners of the land object to the City of Golden being released from <br />their full reclamation responsibility from Empire Pit No. M-1977-534. <br />- Proper top soil, quality and quantity, were not used on our hay <br />meadow which has hindered the development of satisfactory re - <br />vegetation. The top soil that had been collected and stored by the <br />former lease holder, Mountain Aggregates, Inc. was destroyed during <br />the time the City of Golden had the permit. Therefore, when Golden <br />reclaimed our meadow they trucked in poor quality material from <br />Westminster, CO that had very little organic matter. <br />- Non-native weeds were brought in with the soil hauling trucks and <br />these noxious weeds need to be controlled. <br />- Salt contaminated some of the area and it is still barren after two <br />growing seasons. <br />- Some of the debris from the pit operations were buried in the settling <br />ponds and were covered up and are now starting to surface, such as <br />old metal, pipe, asphalt and broken chunks of concrete. <br />- Repair were heavy rain washed out their drainage and is eroding and <br />cutting into our meadow. <br />- Repair and re -install fencing and gates and blend surface into the <br />surrounding area so that water does not stand in holes and ditches. <br />Thank you and we hope to attend your site inspection on October 20, 2015. <br />Sally Guanella Buckland Glenda Guanella <br />✓ Compliance <br />✓ NO Violations <br />
