Hickenlooper <br />Governor <br />Alike King <br />Execu tive Director <br />Dick Wolfe, P.E. <br />Director/State Engineer <br />vSEP 2 2 2015 <br />DIVISION OF RECLAMATION, <br />MINING AND SAFETY <br />This letter is in response to your application of August 14, 2015 submitted on behalf <br />of E-470 Public Highway Authority ("E-470" or "Applicant") requesting a substitute water <br />supply plan ("SWSP") for the Sandy Acres Pit currently permitted as Henderson Development <br />under the Division of Reclamation Mining and Safety (DRMS File No. M-80-110). This plan was <br />submitted pursuant to C.R.S. 37-90-137(11). The fee of $257 for the renewal of the <br />substitute water supply plan has been received (receipt no. 3671163). <br />Plan Operation <br />The Sandy Acres Pit is located on E -470's property in the SE1 /4 of Section 26, Township <br />1 South, Range 67 West of the 6 1 P.M. The mining operations at the Sandy Acres Pit resulted in <br />the creation of an unlined pond, as shown on the attached Figure 1. The Sandy Acres Pit is no <br />longer an active mining site and there are no plans for future mining. E-470 purchased the <br />property containing the Sandy Acres Pit in 2000 in conjunction with the construction of the E- <br />470 highway. This SWSP seeks to replace the evaporation depletions from the Sandy Acres Pit <br />using water teased from the City of Aurora ("Aurora"). <br />Note, that the approval of this substitute water supply plan does not relieve the <br />Applicant and/or landowner of the requirement to obtain a Water Court decree <br />approving a permanent plan for augmentation or mitigation to ensure the permanent <br />replacement of all depletions, including long-term evaporation losses and lagged <br />depletions after gravel mining operations have ceased. The Applicant indicated that the <br />Sandy Acres Pit reclamation plan was amended on September 3, 2014 from unlined <br />ground water pond to backfilling the site. Therefore in order to eliminate the <br />evaporation depletions associated with the pit, E-470 will backfill the pit with inert <br />material from the Brannan Sand and Gravel Company ("Brannan") Pit 29 (DRMS M1980- <br />183).
