OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br /> <br />INSPECTION TOPIC: Financial Warranty <br />PROBLEM/POSSIBLE VIOLATION: Problem: The financial warranty is not adequate to reclaim the site in <br />accordance with the approved reclamation plan. This is a failure to maintain the proper financial warranty <br />amount to complete reclamation of the affected land s pursuant to C.R.S. 34-32.5-117(4)(b) of the Act. <br />CORRECTIVE ACTIONS: The Operator must accept the new bond estimate or submit a Technical Revision, along <br />with the required $216 fee to clarify the Division’s assumptions with respect to the reclamation pla n and revise <br />the 1997 Exhibit L bond estimate. <br />CORRECTIVE ACTION DUE DATE: 11/10/15 <br /> <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Problem: The Division’s disturbed area estimate is 37.7 acres exceeds the <br />maximum allowed disturbed area (at one time) of 35 acres. <br />CORRECTIVE ACTIONS: The Operator must submit one of the following: <br />1. a Technical Revision, along with the required $216 fee to increase the maximum allowed disturbed area; <br />2. documentation demonstrating the actual disturbed area is no more than the required 35 acres; or <br />3. request an acreage reduction of at least 2.7 acres for an area that is reclaimed in accordance with the <br />approved reclamation plan and will not be used for any mining activity in the future. <br />CORRECTIVE ACTION DUE DATE: 11/10/15 <br /> <br /> <br />
