Ebert <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety23q <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />RECEIVED <br />AUG 0 3 2015 <br />Division of Reclamation, <br />Mining & Safety <br />Re: Foidel Creek Mine (Pernut No. C-1982-056), Minor Revision No. 288 (MR -288), 5 Main North Water Pipelines <br />(HC # 67400) <br />Dear Mr. Ebert: <br />Thank you for your correspondence dated and received July 22, 2015 requesting our review and comment on the <br />above referenced undertaking pursuant to Section 106 of the National Historic Preservation Act and its <br />implementing regulations 36 CFR part 800. <br />We again thank you for forwarding supplemental documentation including maps, project description, and the <br />completed cultural resource inventory report titled "Twentymile Coal, LLC: Class III Cultural Resources Inventory of <br />the Proposed 6MN Reservoir and Water Treatment Area, Routt County, Colorado" on July 27, 2015. A clean copy <br />of this report was provided by the cultural resources contractor on July 28, 2015 <br />In consideration of the documentation provided, it is our opinion that a finding of no historic properties affected <br />[36 CFR 800.4(d)(1)] is appropriate for the proposed undertaking. This determination is based on the negative <br />results of prior cultural resources inventories completed within the undertaking's area of potential effects. In the <br />future, we do request that you provide the completed cultural resource inventory form within your initial project <br />submission as it will help facilitate our review and comment. Your attention to this matter is certainly <br />appreciated. <br />The Section 106 consultation process does involve other consulting parties such local governments and Tribes <br />which as stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional information <br />provided by these or other consulting parties may cause our office to re-evaluate our comments and <br />recommendations. <br />Should unidentified archaeological resources be discovered in the course of the project, work must be interrupted until <br />the resources have been evaluated in terms of the National Register of Historic Places eligibility criteria (36 CFR 60.4) <br />in consultation with our office. <br />Thank you for the opportunity to comment.
