<br />Dear Mr. Beecham:
<br />With this submittal, Twentymile Coal, LLC respectfully submits, and requests that the Bureau of Land
<br />Management (BLM) review, process, and approve the accompanying Application for Coal Lease Modification,
<br />which would modify existing leases COC -54608 (720 acres) and COC -81330 (40 acres) to include the Wolf Creek
<br />Coal Seam, in and underlying the following described tracts or parcels of land, located in Routt County, Colorado
<br />(the "Land"):

<br />The original leasing evaluation and Environmental Assessment (EA CO -016-95-020) were completed in 1995, and
<br />the original lease (COC -54608) covering the Wadge Seam only was issued to Cyprus Western Coal Company in
<br />February 1996. The Wadge Seam coal lease includes approximately 2,600 acres in T5N, R86W, Sections 21, 22,
<br />23, 26, 27, 28, and 33. The proposed lease modification tract boundary includes portions of the previously leased
<br />area in Sections 21 and 22, and adds approximately 100 acres in the SWI/4 of Section 21. Refer to Exhibit D for
<br />supporting documents. The majority of the surface overlying the Land is owned by Twentymile Coal, LLC. A
<br />portion of the surface on the eastern edge of the lease modification area is owned by Ashley Investments.
<br />As a component of this application, accompanying this transmittal are; 1) the Corporate Qualifications Statement
<br />for Twentymile Coal, LLC as required under 43 CFR 3472.2-2(c), together with a Certificate of Incumbency from
<br />the Assistant Secretary regarding the officers and directors of Twentymile Coal, LLC; and 2) the Certification
<br />Statement of Compliance with Section 2(a)(2)(A) of the Mineral Leasing Act of 1920, as amended (43 CFR
<br />3472.1-2(e)).
<br />Twentymile Coal, LLC is in compliance with the Mineral Lands Leasing Act of 1920, as amended, and the
<br />requirements of 43 CFR 3472, specifically; a) Twentymile Coal, LLC is the sole party in interest, and is qualified
<br />and authorized to hold interests in the identified Land, and to be issued a lease covering same; b) The interests in
<br />leases or lease applications held, directly or indirectly, by Twentymile Coal, LLC or by any of its affiliated
<br />corporations do not exceed in the aggregate the acreage limitations set forth in 43 CFR 3472.1-3; and c) Neither
<br />Twentymile Coal, LLC nor any affiliated corporations holds or has held for ten (10) years any lease from which it
<br />!� is not producing coal in commercial quantities, except as authorized under the provisions of 43 CFR 3480 or 43
<br />CFR 3472.1-2(e)(4) or (5).
