Hays <br />Division of Reclamation, Mining & Safety �Ile <br />A;6k <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 AGGREGATE <br />INDUSTRIES <br />Re: Permit No. M-1989-120 — Platte Valley - <br />TR -04 Adequacy Review Response <br />Dear Peter: <br />Aggregate Industries (AI) submits the following responses to the Division's_ April 15, 2015 <br />adequacy review of AI's request for a technical revision addressing pit side backfill along the <br />South Platte River in Phase 2 of the Platte Valley Operation: <br />Al confirms its commitment to providing the Division a copy of the Army Corps of <br />Engineers Nationwide Permit when issued for repair of the flood erosion feature on the <br />east side of the South Platte River and will provide notice to the Division when the <br />erosion repair work is completed. <br />2. Al confirms that backfilling of Phase 2 to establish a 200 feet offset from the South Platte <br />River is the intermittent backfilling operation the Operator committed to in Item #17 of <br />the Response to Adequacy Review Comments dated December 1, 2003, for Amendment <br />application AM -01. <br />The backfill as set forth in TR -04, together with the repair of riverbank erosion adjacent <br />to Phase 2, was proposed in anticipation of providing adequate riverbank and pit side <br />protection to eliminate any need to establish the 400 feet river offset at final reclamation <br />as indicated on the approved Exhibit F Reclamation Plan Map. Al acknowledges, <br />however, that the 400 foot offset requirement remains in full force and effect and Al is <br />not seeking approval of a revision to that requirement at this time. <br />Please contact me at (970) 396-5252 or at connie.davis@aggregate-us.com if you need additional <br />information to facilitate approval of TR -004 by the May 18, 2015 decision date. <br />Very truly yours, <br />Connie N.
