Therefore, exposure of <br />ground water must not occur during or after mining operations. If stormwater is contained <br />on -site, it must infiltrate into the ground or be released to the natural stream system <br />within 72 hours or the applicant shall obtain a water court decree to affirm the priority of <br />the storage. <br />® The proposed operation will consume water by: ❑ evaporation, ® dust control, ❑ <br />reclamation, ❑ water removed in the mined product, ® processing, ® other: potable <br />uses for employees. <br />Water used for mining operations (wash plant, crusher, dust control) is proposed to come <br />from a lease of irrigation water from the Citizens Animas Irrigation Company. According to <br />the application, there was an "attached lease and ditch right certificate proving adequate <br />volumes and right to use water for intended use ". However, this office was unable to <br />identify the above - referenced documentation in the application. Any diversion of water <br />for use in the proposed mining operation would be considered a new appropriation of <br />water from the Animas River, which currently has water available for appropriation at this <br />location. Such a diversion may be subject to administration in the water rights priority <br />system in the future; therefore, it is recommended that a water court decree be obtained <br />to affirm the priority of the new appropriation of water. <br />Water used for potable applications is proposed to come from a commercial well. Well <br />permit no. 78905 -F was issued on April 1, 2015 to construct a new well on the property and <br />limits use of the proposed well to commercial drinking and sanitary purposes and industrial <br />use in batch /wash plants for a gravel pit operation, with a maximum pumping rate of 20 <br />gallons /minute and an average annual amount of ground water to be appropriated not to <br />exceed 27.8 acre -feet. <br />COMMENTS: The local Water Commissioner, Jeff Titus, may be contacted at (970) 247 -1845 or <br />Jeff.TitusCstate.co.us regarding administration of water in the area. <br />1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3589 www.water.state.co.us nj <br />
