t2P
AVCOLORADO
Division of Water Resources
Department cf Natural Resources
Office of the State Engineer
1313 Sherman St, Suite 818
Denver, CO 80203
RECEIVED
1/APR 3 U' 2015
,fD; DIVISION OF RECLAMATION,
MINING AND SAFETY
Responsp,to Reclamation Permit Application Consideration
DATE: April 29, 2015
TO: Bob Oswald, Environmental Protection Specialist
CC: Division 7 Office; District 30 Water Commissioner
FROM: Caleb Foy, P.E.
RE: Crossfire Bonds Gravel Pit, File No. M- 2015 -001
Operator: Crossfire Aggregate Services LLC
Contact: Gregg Donaldson, (970) 828 -1811
Sec. 1, Twp. 32N, Rng. 10W, N.M.P.M., La Plata County
CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of
ground water must not occur during or after mining operations. If stormwater is contained
on -site, it must infiltrate into the ground or be released to the natural stream system
within 72 hours or the applicant shall obtain a water court decree to affirm the priority of
the storage.
® The proposed operation will consume water by: ❑ evaporation, ® dust control, ❑
reclamation, ❑ water removed in the mined product, ® processing, ® other: potable
uses for employees.
Water used for mining operations (wash plant, crusher, dust control) is proposed to come
from a lease of irrigation water from the Citizens Animas Irrigation Company. According to
the application, there was an "attached lease and ditch right certificate proving adequate
volumes and right to use water for intended use ". However, this office was unable to
identify the above - referenced documentation in the application. Any diversion of water
for use in the proposed mining operation would be considered a new appropriation of
water from the Animas River, which currently has water available for appropriation at this
location. Such a diversion may be subject to administration in the water rights priority
system in the future; therefore, it is recommended that a water court decree be obtained
to affirm the priority of the new appropriation of water.
Water used for potable applications is proposed to come from a commercial well. Well
permit no. 78905 -F was issued on April 1, 2015 to construct a new well on the property and
limits use of the proposed well to commercial drinking and sanitary purposes and industrial
use in batch /wash plants for a gravel pit operation, with a maximum pumping rate of 20
gallons /minute and an average annual amount of ground water to be appropriated not to
exceed 27.8 acre -feet.
COMMENTS: The local Water Commissioner, Jeff Titus, may be contacted at (970) 247 -1845 or
Jeff.TitusCstate.co.us regarding administration of water in the area.
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3589 www.water.state.co.us nj
