OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Off -site Damage <br />PROBLEM /POSSIBLE VIOLATION: Problem: Based on observations made during this inspection, DRMS believes <br />that land in excess of the 9.4 permitted acres has likely been affected. If this is found to be the case, it would be <br />a possible violation pursuant to: C.R.S. 34- 32.5 - 116(4)(1) for failure to protect areas outside of the affected land <br />from slides or damages occurring during the mining operation. <br />CORRECTIVE ACTIONS: The operator will have until June 30, 2015 to submit a complete application (fee, <br />completed application form, and all required exhibits) for a permit conversion or amendment to DRMS to <br />resolve the existing boundary issue, or demonstrate to DRMS via a site survey conducted by a registered <br />surveyor that the total existing disturbance is less than or equal to 9.4 acres. <br />If the boundary issue is unresolved by June 30, 2015 DRMS will pursue a possible violation through a hearing <br />before the Mined Land Reclamation Board. If required, the schedule and other details for the MLRB hearing will <br />be provided under a separate document to be sent via certified mail to the operator. <br />CORRECTIVE ACTION DUE DATE: 6/30/15 <br />INSPECTION TOPIC: Signs & Markers <br />PROBLEM /POSSIBLE VIOLATION: Problem: The affected area boundary markers are missing or incorrectly <br />placed. This is a problem for failure to maintain boundary markers around the affected area as required by <br />Section 3.1.12(2) of the rule. Lack of, or improper placement of, adequate boundary markers has likely led to <br />minor off -site impacts which will require submittal of a permit amendment or conversion application to DRMS <br />by June 30, 2015. <br />Page 1 of 4 <br />
