The Division is required to make an approval or denial'decision no <br />later than April 17, 2015 therefore; a response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />1. The Division accepts the Operators plan to repair the flood erosion feature on the east side <br />of the South Platte River. The Operator committed to providing the Division a copy of the <br />Army Corps of Engineers Nationwide Permit 3 (NWP) when issued and provide notice to the <br />Division of the completed erosion repair work. <br />2. The Operator states completion of the riverbank project will re- establish AI's pre -flood land <br />extent and thus the minimum 100 -feet off -set from the South Platte River to Phase 2 of the <br />Platte Valley site. In order to provide additional protection between Phase 2 and the South <br />Platte River, Al proposes to stabilize the pit side of Phase 2 by backfilling to grade <br />approximately 840 lineal feet along the west boundary to establish a total 200 -foot off -set <br />from the South Platte River. <br />Please confirm the backfilling of Phase 2 to establish a 200 feet offset from the South Platte <br />River is the intermittent backfilling operation the Operator committed to completing by <br />April 2004 in Item #17 of the Response to Adequacy Review Comments, dated December 1, <br />2003, for Amendment application AM -01. <br />COt0 <br />I w� of <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
