With this submittal, Twentymile Coal, LLC (TC) is providing the Wolf <br />Creek Subsidence Evaluation Report, an updated Mine Plan Map, and relevant updated subsidence <br />text. In general, the updated subsidence text does not change significantly from the previously <br />submitted text, with the only changes being minor edits to assure consistency between the text and the <br />final Subsidence Report. <br />We have reviewed both our existing agreements relative to potential subsidence effects, and the Permit <br />mitigation and monitoring plans. All potential subsidence effects associated with the proposed Wolf <br />Creek Reserve mining activities are addressed by either existing agreements or the identified <br />mitigation and monitoring plans. Existing agreements are in -place which cover potential subsidence <br />effects for Routt County Road 33 (RCR33) and the Yampa Valley Electric — Fish Creek/Steamboat <br />Powerline. While potential subsidence effects on other lands and structures are adequately addressed <br />by the mitigation and monitoring plans. we are currently finalizing negotiations on updated subsidence <br />agreements for the Union Pacific Energy Spur and the Ashley Property (current agreement expires in <br />08/15), and expect to be able to provide those final agreements in the near future. <br />We appreciate your timely review of this response submittal package and look forward to approval of <br />the pending Permit Revision application.
