Bestway has been operated Baseline Resource <br />Pit together with the adjacent Parker - Dersham Pit (DRMS M2006 -003). According to our records, the <br />eastern portion of the Baseline Pit is encompassed by an existing slurry wall, and is known as Robert <br />W. Walker Reservoir (WDID 0203358). Also, the majority of the western portion of the Baseline Pit <br />and the southern portion of the Parker - Dersham Pit is encompassed by an existing slurry wall, and is <br />known as Kirby - Dersham Reservoir (WDID 0203386). These two slurry walls were approved by the <br />State Engineers Office on September 11, 2007 and December 16, 2011, respectively. Also, a <br />combined substitute water supply plan ( "SWSP ") for the Baseline Resource Pit and Parker - Dersham <br />Resource Pit was submitted to the State Engineer's Office ( "SEO ") on December 13, 2014 and this <br />SWSP was approved on February 20, 2015. The SWSP is valid until December 31, 2015. <br />The SEO has no objection to the request for financial warranty reduction for the Baseline Resource <br />Pit, provided, Bestway continues to operate the remaining area to be mined at the site in <br />accordance to an approved SWSP or approved plan for augmentation. In addition water shall not be <br />impounded in the reservoirs except pursuant to lawful diversions allowed by statute or decree. At all <br />other times, all inflow of water into the reservoirs from any source, including precipitation and <br />ground water inflows, shall be removed by the applicant.
