Application Form Application form has been re- drafted to reflect company <br />name as listed with Secretary of State. <br />2. Exhibit A —Legal Description- Conversion Application has been revised to <br />match legal description acreage. <br />Exhibit C- Pre - mining and Mining Plan Map <br />3. Revised Pre - mining and Mining Plan Map shows from left to right on the inset <br />berm cross section a minimum 10'setback from owner's property line to the <br />bonded permit boundary. In agreement with DRMS understand, the entire berm <br />is included within the permit area. <br />4. Map revision reflects five foot contour intervals to more clearly delineate grade <br />and direction of slopes. <br />5. Text in the mining plan narrative has been revised to state "minimum' set -back <br />distance of 10'. <br />6. Map is labeled to reflect vegetative types as listed under NRCS data. <br />7. Pre - mining and Mining Plan Map as well as Reclamation Maps have been signed <br />by Kenneth S. Klco, Consulting Geologist, Azurite, Inc. <br />Exhibit D- Mining Plan <br />8. Mine plan will include a statement that explosives will not be used at this site. <br />9. In the last paragraph of page one of the Mine Plan, it states that a 15- 18'mining <br />face may be entertained. Given an -economic limit of 1:1 stripping ratio, a <br />maximum total mining depth estimate might approach 36'. <br />Exhibit E- Reclamation Plan ' ' <br />10. The Custer County Zoning Resolution, (custercountygov.com), map shows this <br />area to be in Zone II, Sangre De Cristo District. Page 58 of Resolution states that <br />the zoning type is intended for both agricultural and residential use, with a <br />minimum 35 acre lot size.
