A slurry wall has been constructed around the perimeter of the
pit and the lining of the Perry Pit has been approved by the State Engineer in a letter dated June 9,
2006.
During the September 2013 flooding there we some damages sustained to the slurry wall. The slurry
wall liner was repaired at the location of the damage areas and tied back into the existing slurry wall
liner. The lining repair for the Perry Pit was approved by the State Engineer in a letter dated
December 17, 2014. The Applicant is requesting a reduction of the bonded amount associated with
the repairing cost of the slurry wall.
Since the Perry Pit East Reservoir is once again classified as a lined reservoir in accordance with the
1999 SEO Guidelines, the State Engineer's Office has no objection to the proposed financial warranty
reduction for the Perry Pit. However, water shall not be impounded in the reservoir except pursuant
to lawful diversions allowed by statute or decree. At all other times, all inflow of water into the
reservoir from any source, including precipitation and ground water inflows shall be removed to prevent
illegal storage of water. Prior to ANY use of this site, the owner or operator will need to coordinate
with Mr. William Schneider, District 2 Water Commissioner, to review operations, measurement
structures, and accounting.
The applicant may contact the State Engineer's Office with any questions.
ov coy
iQ
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water.state.co.us
RECEIVED
COLORADO
"vision of Water Resources
A7
MAR 0 3 2015
Department of Natural Resources
OMSION OF RECLAMATION
1313 Sherman Street, Room 821
U NiN10AND SAFETY
Denver, CO 80203
1----5A -a 3
Response to Reclamation Permit Release Request Consideration
DATE: March 3, 2015
TO: Peter S.
