<br />COMMENTS: Northern Colorado Contractors, Inc. has requested a financial warranty reduction for
<br />the Perry Pit, Permit No. M1990 -098. A slurry wall has been constructed around the perimeter of the
<br />pit and the lining of the Perry Pit has been approved by the State Engineer in a letter dated June 9,
<br />2006.
<br />During the September 2013 flooding there we some damages sustained to the slurry wall. The slurry
<br />wall liner was repaired at the location of the damage areas and tied back into the existing slurry wall
<br />liner. The lining repair for the Perry Pit was approved by the State Engineer in a letter dated
<br />December 17, 2014. The Applicant is requesting a reduction of the bonded amount associated with
<br />the repairing cost of the slurry wall.
<br />Since the Perry Pit East Reservoir is once again classified as a lined reservoir in accordance with the
<br />1999 SEO Guidelines, the State Engineer's Office has no objection to the proposed financial warranty
<br />reduction for the Perry Pit. However, water shall not be impounded in the reservoir except pursuant
<br />to lawful diversions allowed by statute or decree. At all other times, all inflow of water into the
<br />reservoir from any source, including precipitation and ground water inflows shall be removed to prevent
<br />illegal storage of water. Prior to ANY use of this site, the owner or operator will need to coordinate
<br />with Mr. William Schneider, District 2 Water Commissioner, to review operations, measurement
<br />structures, and accounting.
