The status of the corrective actions is as follows:
Compliance Problem #1: Availability of Records. This problem has been resolved as a result of
receiving the Highline Electric Association letter (on utility letterhead) regarding the overhead power line
that crosses the northeast corner of the permit boundary. The letter states: "The mining and reclamation
activities as proposed will remain at least 50 ft. from HEA infrastructure and therefore will have no
negative effect on the operation and maintenance for the power line facility structures ".
The terms of this structure agreement, reviewed by the Division, are hereby incorporated into Permit No. M-
2005-032. All other conditions and requirements of Permit No. M- 2005 -032 remain in full force and effect.
If you need additional information or have any questions, please contact me at Division of Reclamation, Mining
and Safety, 1313 Sherman Street, Room 215, Denver, CO 80203, by telephone at 303 - 866 -3567 x8132, or by email at
elliott.russellAstate.co.us.
Sincerely,
Elliott R.
