Bowles
Environmental Protection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman St., Room 215
Denver, Colorado 80203
RECEIVED
FEB 2 0 201
Division of Reclamation,
Mining & Safety
Re: New Horizon Mine (Permit No. C- 1981 -008), Technical Revision No. 65 (TR -65), Addition of BB Detour
Road to Permit Area (CHS #67409)
Dear Mr. Bowles:
Thank you for your correspondence dated February 3, 2015 (received by our office on February 9, 2015)
regarding the subject undertaking.
While we understand that the above - referenced technical revision does involve new surface disturbance,
proposed activities are limited in scope. Specifically, TR -65 proposes to add and reclaim portions of an existing
haul road that currently extends outside of the current permit area. Assuming that ground disturbance is limited
to those areas already disturbed, it is our opinion that a finding of no historic properties affected is appropriate
for this undertaking pursuant to 36 CFR 800.4(d)(1).
The consultation process does involve other consulting parties including local governments and Tribes, which as
stipulated in 36 CFR 800.3 are required to be notified of the undertaking. Additional information provided by
these consulting parties may cause our office to re- evaluate our comments and recommendations.
If previously unidentified archaeological resources are discovered in the course of the project, work must be
interrupted until the resources are properly evaluated in terms of the National Register of Historic Places
eligibility criteria (36 CFR 60.4) in consultation with our office.
Thank you for the opportunity to comment. If we may be of further assistance, please contact Mark Tobias,
Section 106 Compliance Manager, at (303) 866 -4674 or mark.tobiasQstate.co.us.
Sincerely,
T ,
.F Edward C.
