(NCC) is requesting a reduction in the current bond for the
financial warranty that is in place for Perry Pit. We are requesting that the following items be
reduced to zero and removed from the current financial warranty that is posted because the
slurry wall has been constructed and accepted by the State Engineer's Office (SEO). J.C. York
with J &T Consulting, Inc. sent a copy of the acceptance letter from the SEO to you via e-mail on
January 26, 2015.
1. Slurry Wall Repair: The costs associated with repair of the slurry wall that was
completed in 2014 were $277,364.55 and 20% of the repair cost was bonded for at
$55,472.89. This amount should be reduced to zero now that the slurry wall repairs are
completed and the leak test passed and was accepted by the SEO.
The current bond amount in place for the financial warranty is $369,459.89.
Reducing the current bond amount by the $55,472.89 the revised bond amount should now be
$313,987.00.
NCC appreciates your consideration of this bond reduction request and looks forward to your
response.
Please feel free to contact me with any questions or comments.
Sincerely,
"- f
AF & Report
No Violations
