Scott, Environmental Protection Specialist <br />CC: Division 1 Office, District 2 Water Commissioner <br />FROM: loana Comaniciu, P.E. <br />RE: Parker - Dersham Resources Gravel Pit, File No. M- 2006 -003 <br />Operator: Bestway Concrete Company <br />Contact: (970) 587 -7277 <br />Section 36, Twp 1 North, Rng 67 West, 6th P.M., Adams County <br />COMMENTS: Bestway Concrete Company ( "Bestway ") has requested a financial warranty reduction <br />for the Parker - Dersham Resource Pit, Permit No. M2006 -003. Bestway has been operated Parker - <br />Dersham Resource Pit together with the adjacent Baseline Pit (DRMS M1997 -058). According to our <br />records, the majority of the western portion of the Baseline Pit and the southern portion of the <br />Parker - Dersham Pit is encompassed by an existing slurry wall, and is known as Kirby - Dersham <br />Reservoir (WDID 0203386). The lining of this slurry wall was approved by the State Engineers Office <br />on December 16, 2011. Also, a combined substitute water supply plan ( "SWSP ") for the Parker - <br />Dersham Resource Pit and Baseline Pit was submitted to the State Engineer's Office ( "SEO ") on <br />December 13, 2014 and this SWSP is pending approval. <br />The SEO has no objection to the request for financial warranty reduction for the Parker - Dersham <br />Resource Pit, provided, Bestway continues to operate the remaining area to be mined at the site in <br />accordance to an approved SWSP or approved plan for augmentation. In addition water shall not be <br />impounded in the reservoir except pursuant to lawful diversions allowed by statute or decree. At all <br />other times, all inflow of water into the reservoir from any source, including precipitation and <br />ground water inflows, shall be removed by the applicant.
