Box 247 <br /> Cripple Creek, CO 80813 <br /> RE: Mineral Mountain Gold,LLC., Mineral Mountain Project, File No. M-2014-045; <br /> VFinal DMO Designation <br /> Dear Mr. Barker: <br /> Pursuant to Rule 7.2.4(1)(a), the Division met with you and Mr. Art Braun on December 15, 2014 <br /> to discuss the pending DMO designation for the Mineral Mountain Project. Division staff met the <br /> week of January 5, 2015 to discuss the points presented by you and Mr. Braun against the DMO <br /> designation. The Division's position is that these points did not satisfactorily demonstrate that the <br /> Operation should not be a DMO. Further, the Division believes that pursuant to Rule 1.1(14) (b) <br /> and (c) that toxic or acid-forming materials will be exposed or disturbed as a result of mining <br /> operations; and acid mine drainage has the potential to occur due to mining or reclamation activities <br /> associated with this project. This letter serves as notification of the Division's final determination <br /> for the Operation should be a DMO. <br /> Pursuant to Rule 7.2.4(1)(b),the Operator/Applicant may appeal the Division's determination to the <br /> Board within thirty (30) days of the notification to the Operator/Applicant of such determination, <br /> and request a hearing before the Board on the designation by the Division pursuant to Rule 1.4.11. <br /> Burden of proof to reverse the Division's determination shall be on the Operator/Applicant. <br /> If you have any questions,please contact me(303-866-3567 ext. 8169). <br /> Sincerely, <br /> ../74j....._:- <br /> Timothy A.
