COLORADO
Division of Water Resources
Department of Natural Resources
1313 Sherman Street, Room 821
Denver, CO 80203
Response to Reclamation Permit Financial Warranty Reduction Request Consideration
DATE: January 7, 2015
TO: Eric C. Scott, Environmental Protection Specialist
CC: Division 1 Office, District 5 Water Commissioner
FROM: loana Comaniciu, P.E.
RE: The Shores Pit, File No. M- 1998 -013
Operator: Bestway Concrete Company, (970) 587 -7277
Sec. 1 Et 2, Twp. 2 North, Rng. 68 West, 6th P.M., Weld County
5A,*
COMMENTS: Bestway Concrete Company has requested a financial warranty reduction for the Shores
Pit, Permit No. M1998 -013. The site contains four slurry walled areas, designated as cells A through
D. Together these four cells are planned to eventually be connected via pipelines, by others, and
become Shores Lake (WDID 0503900) as adjudicated in case no. 2000CW83. Cells A, B, C, and D were
initially dewatered and dry mined. A slurry wall was constructed around cells A and B and lining for
these cells was approved on January 11, 2007. A slurry wall was also constructed around cell C and
lining was approved on December 7, 2009. A slurry wall was constructed around cell D and was
approved on October 8, 2013. The only remaining area to be mined at the site is the area known as
the Burch property. A substitute water supply plan ( "SWSP ") for the Shores Pit was submitted to the
State Engineer's Office ( "SEO ") on December 17, 2014 and this SWSP is pending evaluation.
The SEO has no objection to the request for financial warranty reduction for the Shores Pit, provided
the Applicant will continue to operate the remaining area to be mined at the site in accordance to
an approved SWSP or approved plan for augmentation. The applicant may contact the State
Engineer's Office with any questions.
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.3585 www.water.state.co.us
—C 0
* 1876
