RECF' DEC 3 0 7014 December 26,2014 DIVISION OF RECLAMATION MINING AND SAFETY Jr. Tyler O'Donnell ;/Division of Reclamation Mining and Safety 1313 Sherman Street, Room 215 AGGREGATE Denver, CO 80203 ,� INDUSTRIES Re: Permit No. M-2004-031 —Hazeltine Mine - Corrective Action Extension Request Dear Tyler: Aggregate Industries (AI) is requesting an extension of time to address corrective actions set forth in the Division's report of its October 31, 2614 inspection relative to property owned by Fred Orr,which is adjacent to the Haze mh e Mine. The current corrective action date is December 30, 2014. As noted in the previous extension request dated November 20, 2014, AI `s preferred approach to resolving this issue is to negotiate with Mr. On for purchase of his property, which would eliminate the need to lower the pipe and further reduce surface water levels. When I originally discussed this with you, I had requested that AI be provided an extension to the end of January, 2015 in order to allow an adequate time to receive corporate approval for the funds to pursue the purchase negotiation. Upon your request, we only requested the extension to December 30. We are still working on obtaining such approval but will not have a response until after the first of the year. We would once again respectfully request the Division's approval of an extension to January 31, 2015. If we are unable to obtain approval or, upon approval are unsuccessful in negotiating a purchase agreement with Mr. On, we will submit a technical revision addressing the required corrective action set forth in the October 31, 2014 inspection report.
