Review of this application determined the following items must be received before the Division can consider <br />the application as being submitted and the technical review can begin. <br />Application <br />1. The question number 5.2 was left blank on the first page of the application. Please indicate the anticipated <br />end use of the primary commoditie(s) to be mined and resubmit page 1 of the application. <br />2. The certification, page 7 of the application, was not completed correctly. Near the bottom of the page, where <br />it states "The foregoing instrument was acknowledged before me on..." needs to be filled out with <br />information of the person who signed the certification page (Mark Brown). Please re- submit a corrected and <br />notified certification page. <br />6.3.5 Exhibit E — May <br />3. The four maps submitted in Exhibit E (Aerial, Site, Mining Plan, and Reclamation Plan Maps) all are <br />lacking a distinct permit boundary. Please re- submit these maps showing the proposed permit boundary. <br />Please note that all proposed mining- related disturbances must be within the proposed permit boundaries; <br />this includes all access and haul roads. <br />6.3.12 EXHIBIT L — Permanent Man -made Structures <br />Where the mining operation will adversely affect the stability of any significant, valuable and permanent <br />man -made structure located within two hundred (200) feet of the affected land, the applicant may either: <br />a. provide a notarized agreement between the applicant and the person(s) having an interest in the <br />structure, that the applicant is to provide compensation for any damage to the structure; or <br />b. where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br />evaluation that demonstrates that such structure shall not be damaged by activities occurring at the <br />mining operation; or <br />c. where such structure is a utility, the Applicant may supply a notarized letter, on utility letterhead, <br />from the owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no <br />negative effect" on their utility. <br />Col\ <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
