AFFIDAVIT OF PUBLICATION STEAMBOAT PILOT & TODAY STATE OF COLORADO COUNTY OF ROUTT I, Kalli Deatherage, do solemnly swear that I am Legal Notice Representative of theSteamboat Pilot & Today, that the same is a daily newspaper printed, in whole or in part, and published in the County of Routt, State of Colorado, and has a general circulation therein; that said newspaper has been published continuously and uninterruptedly in said County of Routt for a period of more than fifty -two weeks prior to the first publication of the annexed legal notice or advertisement; that said newspaper has been admitted to the United States mails as second -class matter under the provisions of the Act of March 3, 1879, or any amendments thereof, and that said newspaper is a daily newspaper duly qualified for publishing legal notices and advertisements within the meaning of the laws of the State of Colorado. Subscribed and sworn to before me, a Notary Public in and for the County of Routt, 14102 -1 NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Min- ing and Safety proposes to approve Techi- cal Revision Application No. 83 (TR -83) for the Foldel Creek Mine (Permit No. C -1982 -058), submitted by Twerdymile Coal, LLC. Technical Revision No. 83 (TR -83) re- quests to modify Twentymils Coal LLC's ap- proved mine plans to include initial develop- ment for the Wolf Creek Coal Seam Reserve. Initial development will include development and placement of long -term support for a 3 -entry rock slope access, development of up to six sets of gate -roads and bleeder en- tries, and related ancillary activities including, underground dewatering activities and the extension of mine ventilation and support systems. The Foidel Creek Mine is a/an underground coal mine located in Routt County, approxf mately 23 miles SW of Steamboat Springs, Colorado. Coal interest is federal, state and private, and the surface affected is federal, state and private land. The permit area en- compasses approximately 20, 10(100 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 33 101, at seq., C.RS., and the regulations promulgated thereunder. Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado Division of Reclamation, Miring and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver, Col- orado 80203. Persons with an interest that may be adversely affected by the proposed decision may request aformal hearing before the Mined Land Reclamation Board on the proposed decision.
