NOV 2 5 2014 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />November 20, 2014 <br />Mr. Tyler O'Donnell <br />Division of Reclamation Mining and Safety <br />1313 Sherman Street, Room 215 AGGREGATE <br />Denver, CO 80203 <br />INDUSTRIES <br />Re: Permit No. M- 2004 -031 — Hazeltine Mine - Corrective Action Extension Request <br />Dear Tyler: <br />Aggregate Industries (AI) is requesting an extension of time to address corrective actions <br />set forth in the Division's report of its October 31, 2014 inspection relative to property <br />owned by Fred Orr, which is adjacent to the Hazeltine Mine. <br />As we discussed this morning, Al is considering lowering the agri -drain pipe that was <br />installed to reduce surface water levels in the vicinity of the Orr property. This option is <br />being assessed, however, with regard to potential impacts to mitigation wetlands <br />constructed in accordance with AI's Army Corps of Engineers 404 permit requirements <br />as well as AI's commitment to City of Thornton for water storage. <br />Due to these potential impacts, Al prefers to explore the option of re- negotiating with Mr. <br />Orr for purchase of his property which would eliminate the need to lower the pipe and <br />further reduce water levels. Al is in the process of seeking approval for funding this <br />option and upon approval will contact Mr. Orr to explore this avenue. <br />In order to proceed as proposed above Al requests an extension of the corrective action <br />response date to December 30, 2014. At that time Al hopes to have initiated <br />conversation with Mr. Orr to negotiate the land purchase. If successful in reaching a <br />reasonable consensus for such purchase, it will likely take a longer period of time to <br />finalize terms of an agreement and Al would then request additional extension(s) as <br />necessary until closing on the purchase. <br />We appreciate your consideration in this matter. <br />Very truly yours, <br />Connie N.
