Adequacy Response #1
On behalf of my client Franson Family Partnership , I am responding to your
adequacy review letter dated October 10, 2014. I have included your review points that need
to be addressed as presented in the letter so the questions and answers will be in the same
document for easy reference.
1. As required by Rule 1.6.2(d) and 1.6.5(2), please submit proof of publication in a newspaper
of general circulation in the locality of the proposed mining operation.
Attached is a copy of the Proof of Publication from the Yuma Pioneer published
10/2/14.
2. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of
surface and mineral rights of the affected land and the owners of record of all land surface
within 200 feet of the boundary of the affected land; this includes all easement holders located
on the affected land and within 200 feet of the boundary of the affected land. Proof of notice
may be return receipts of a Certified Mailing or by proof of personal service.
Attached are copies of the return receipts from the adjoining owners within 200 feet of
the permit boundary.
3. The Division received comments from Colorado Parks and Wildlife, the Division of Water
Resources, and History Colorado. The letters are attached for review. Please acknowledge and
address any comments noted in the letters and make changes to the application as necessary.
