Scheffel & Associates, P.C. <br /> 3801 East Florida Avenue, Suite 600 <br /> Denver, Colorado 80210 <br /> RE: Complaint against Aggregate Industries-WCR, Inc. <br /> Dear Mr. Weber, <br /> I represent Colorado's Division of Reclamation, Mining and Safety and received a <br /> copy of the October 7, 2014 letter relaying a complaint regarding Aggregate <br /> Industries-WCR, Inc., from your client, Ms. Weber-Smith. <br /> The Division has the authority to enforce and administer the provisions of the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials, §§ 34- <br /> 32.5-101 through 34-32.5-125. For construction material extraction, the Act <br /> authorizes the Division to inspect and regulate mining operations for compliance <br /> with the Act, its implementing rules, and the operator's permit conditions. <br /> Unfortunately, the provisions of the Act do not authorize the Division to regulate <br /> the operation of trucks from a construction material mining operation outside of the <br /> mine permit area. <br /> The Division appreciates and welcomes citizen's complaints and, as an agency <br /> practice, inspects any complaint if the complaint is within the Division's <br /> enforcement authority.
