DRMS has reviewed <br />the request to revise the mining plan for the Burch Parcel, however, the Division will <br />need Bestway to clarify some details (quantities used in reclamation estimate), and <br />provide additional information, before a decision can be issued on this revision request. <br />(1) What is the current minimum depth to static groundwater in the Burch parcel? <br />(2) What is the proposed total depth of excavation at the Burch Parcel? <br />(3) How many cubic yards of material will be required for each stage of proposed <br />mining to backfill the excavations to at least two feet above static water level, and will <br />there be sufficient overburden/backfill available on -site to achieve this without <br />importation of additional material? <br />(4) DRMS will require Bestway to commit that topsoil be salvaged from the Burch <br />Parcel to be used in site reclamation. <br />(5) Please show on the map submitted where the stockpiled overburden and topsoil to <br />be used in the proposed backfill reclamation will be placed. <br />(6) Does Bestway still intend to reclaim this area as developed water storage? If so, at <br />what point in the mining plan does Bestway intend to install /test the slurry wall? <br />(7) Bestway still has not submitted a groundwater monitoring plan for DRMS review <br />and approve prior to the exposure of groundwater in the Burch parcel as required in the <br />approval of AM02. <br />(8) Bestway will need to provide signed damage waiver agreements with all structure <br />owners within 200' of mining activity in the Burch parcel (Weld County, Last Chance <br />Ditch, Rural Ditch, Anadarko) that are not yet on file, or if they cannot be obtained, <br />provide a geotechnical assessment that will confirm that the proposed activities will have <br />no adverse impact on these structures. <br />l�tv CFA 2�P\ <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining. state. co. us <br />�- ""? 0 <br />John W.
