SUITE C
PO BOX 2270
DURANGO, CO 81302
970/259.8747
FAX 970/259.8790
Upon review of the DRMS file concerning M- 2013 -0.36, I came across your letter to the
Applicant dated September 23, 2014, whereby you suggest my letter of objection on behalf of
the AttkissonsBradshaws dated August 26, 2014 and received in your offices on August 27,
2014 was part of "late objections." We object to your characterization of the August 26, 2014
objection letter as not timely. My clients received the enclosed Public Notices (presumably from
the Applicant) via Certified Mail stating, in relevant part, that: "Comments concerning the
application and exhibits must be in writing and must be received by the Division of Reclamation,
Mining, and Safety by 4:00 p.m. on August 28, 2014." My clients relied on this Notice to lodge
their objections and we submit that there has been full compliance. As such the objections
received prior to the Notice deadline should be treated as having been received timely.
Please make these notices part of the DRMS file and note as timely, the submittal of those
objections received prior to 4:00 p.m. on August 28, 2014.
Thank you for your attention to these matters.
Sincerely,
GOLDMAN, ROBBINS & NICHOLSON, P.C.
Michael A.
