The rock testing report was first requested in the Preliminary Adequacy Review (see Comment #3) <br /> dated September 8, 2014. The response to the Division's first adequacy was received on September 17, 2014 at <br /> 12:15 pm (four hours and 45 minutes before the decision date at the time (9/17/2014 at 5:00 pm) and was <br /> incomplete in that the requested rock testing report was not included. <br /> The Division strives to provide timely feedback on all permitting actions, but does not appreciate needing to make <br /> hasty decisions as this can potentially lead to errors in the process. <br /> Due to: a)the the incomplete September 17, 2014 response and the fact that the Division was trying to determine <br /> if the the Mineral Mountain Project should be a designated mining operation (DMO); and b) the Applicant is <br /> permitting over two NOls and an approved mine reclamation permit, the Division deemed the application <br /> "complex" allowing an additional 60 days to adequately review the application. <br /> Due to the late submittal of the rock testing report, the Division will need extra time to review this new information <br /> prior to completing its second adequacy review.
