Box 33695
Denver, CO 80233-0695

Re: New Horizon Mine (Permit No. C-1981-008), TR-64, adequacy letter

Dear Mr. Gilbreath:

We received your technical revision application (TR-64) regarding revisions to the trench drain design on
August 19, 2014, and your application was deemed complete on August 27, 2014. The following two issues
have been identified with the submittal:

DRMS requires proof that this plan has been approved by the Water Quality Control Division
(WQCD). We would prefer that this be a revised CDPS permit. However, if you can provide proof
that this revision from the WQCD is imminent (for example in a letter from a senior staff member),
that would also suffice.

Please address the issue of constructing the pipeline in the buffer zone along Tuttle Draw.

Please provide an updated submittal that addresses each issue.

I have another comment. The construction of the pipeline must not jeopardize the integrity of the
embankment for Pond 013.

If you have any questions, please contact me at 303.866.3567 (extension 8113) or Rob.Zuber@state.co.us.

Sincerely,

Robert Zuber, P.E.
Environmental Protection Specialist

1313 Sherman Street, Room 215, Denver, CO 80203P 303.866.3567 F 303.832.8106 http://mining.state.co.us

John W.
