The Division of Reclamation, Mining and Safety has conducted an inspection of the mining operation
noted below. This report documents observations concerning compliance with the terms of the permit
and applicable rules and regulations of the Mined Land Reclamation Board.

The following inspection topics were identified as having Problems or Possible Violations. OPERATORS
SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE
WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a
Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land
Reclamation Board will consider possible enforcement action.
INSPECTION TOPIC: Hydrologic Balance
PROBLEM/POSSIBLE VIOLATION: Problem: The Operator is not in compliance with the Division's exposed
groundwater policy. The Operator has not obtained a court approved augmentation plan or provided bonding
sufficient to cover alternate methods to mitigate injurious stream depletions that result from mining related
exposure of groundwater.
CORRECTIVE ACTIONS: The Operator shall complete one of the options identified in the body of this report on
or before the corrective action date.
CORRECTIVE ACTION DUE DATE: 9/19/14
INSPECTION TOPIC: Reclamation Success
PROBLEM/POSSIBLE VIOLATION: Problem: Mining at the Gardels Pit was completed over five years ago and the
Operator has failed to complete reclamation. Pursuant to Construction Materials Rule 3.1.3, all reclamation is to
be completed within five years from the date that mining ceases.
CORRECTIVE ACTIONS: The Operator shall submit an augmentation plan to the appropriate water court for
approval within 180 days of the mailing date of this report and shall provide written documentation
demonstrating the augmentation plan has been filed in court.
