OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Hydrologic Balance <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The Operator is not in compliance with the Division's exposed <br /> groundwater policy. The Operator has not obtained a court approved augmentation plan or provided bonding <br /> sufficient to cover alternate methods to mitigate injurious stream depletions that result from mining related <br /> exposure of groundwater. <br /> CORRECTIVE ACTIONS: The Operator shall complete one of the options identified in the body of this report on <br /> or before the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 9/19/14 <br /> INSPECTION TOPIC: Reclamation Success <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Mining at the Gardels Pit was completed over five years ago and the <br /> Operator has failed to complete reclamation. Pursuant to Construction Materials Rule 3.1.3, all reclamation is to <br /> be completed within five years from the date that mining ceases. <br /> CORRECTIVE ACTIONS: The Operator shall submit an augmentation plan to the appropriate water court for <br /> approval within 180 days of the mailing date of this report and shall provide written documentation <br /> demonstrating the augmentation plan has been filed in court. <br /> CORRECTIVE ACTION DUE DATE: 2/16/15 <br /> Page 1 of 5 <br />
