OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance and Offsite Impacts <br />PROBLEM /POSSIBLE VIOLATION: Problem: Alluvial groundwater is mounding against the slurry wall on the <br />upgradient side of the site and causing flooding in a neighbor's pasture. A mitigation plan is needed to ensure <br />compliance with C.R.S. 34- 32.5- 116(4)(h) and (i). <br />CORRECTIVE ACTIONS: Submit to DRMS by August 20, 2014 a groundwater mounding mitigation plan as either <br />a Technical Revision or Amendment to the permit. The plan must include: <br />1. A detailed description of the measures the operator will take to reduce groundwater mounding outside <br />Pit 29 to a level that eliminates flooding on the Einspahr property, <br />2. A time schedule for implementing the plan, and <br />3. Enough information for DRMS to estimate the cost of implementing the plan. <br />CORRECTIVE ACTION DUE DATE: 8/20/14 <br />OBSERVATIONS <br />This inspection was conducted by Tom Kaldenbach of DRMS. The mine operator was represented by Theran <br />Olsen and Gerardo Orozco. Norm Einspahr was also present during the inspection. Mr. Einspahr owns a house <br />and pasture that is located next to Pit 29. <br />The inspection was conducted in response to a complaint DRMS received by phone from Mr. Einspahr on July <br />28, 2014. Mr. Einspahr reported flooding in his approximate 6 -acre pasture. The pasture is flanked by <br />permitted gravel operations on the east and north (Brannan Sand and Gravel Pit 29) and on the west (Albert Frei <br />Page 1 of 5 <br />
