COMMENTS:
Schmidt Construction Company has submitted a request for partial acreage release for Coal
Creek Resources Pit, Permit No. M-1988-044.
The current permitted area is 2,632.08 acres. The acreage to be released consists of lands
previously leased from the Colorado Board of Land Commissioners ("Board"). The Board
amended the existing lease, which eliminates a big portion of the previously leased area. The
new lease and after eliminating oil and gas development lands that was previously removed
from the permit, the resulting new permit area is approximately 715 acres. The land allowed to
be mined under the new lease will be limited to area 1 U, as shown on the attached map.
According to the 2014 annual report the lands previously included in the permitted area and
proposed to be released were not disturbed. In addition the South Lowland Parcel (26 acres)
has been reclaimed. This office has no objection to the request for the partial acreage release
for the Coal Creek Resources Pit.
