COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />May 16, 2014 <br />Jim Wilkinson <br />U.S. Bureau of Land Management <br />Colorado River Valley Field Office <br />2300 River Frontage Road <br />Silt, CO 81652 <br />Re: North Thompson Creek Mine (Permit No. C- 1981 -025) <br />Technical Revision No. 28 (TR -28) <br />Pond 9 Spillway Design <br />Dear Mr. Wilkinson: <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on May 16, 2014 an <br />application to revise coal mining operations at the North Thompson Creek Mine was considered <br />complete for the purposes of filing. The revision was submitted by MINREC, Inc. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br />TR -28 is being submitted as one of the requirements for the abatement of Violation no. CV -2014- <br />001. The violation was issued to MINREC Inc. on May 8, 2014 because the primary and <br />emergency spillways for Pond 9 were not operating as designed (see April 23, 2014 inspection <br />report). TR -28 proposes a new Pond 9 primary and emergency spillway design. The applicant is <br />not proposing additional surface disturbance outside of the area currently approved for disturbance. <br />The underground coal mining operation is on land located approximately 10 miles Southwest of <br />Carbondale, Colorado. The permit area is further described as follows: <br />T8S, R89W; Portions of Sections 21, 22, 27, 28, 33, 34 and 35 <br />T9S, R89W; Portions of Sections 2, 3 and 4 <br />T7S, R88W; Portions of Sections 20, 29, 30 and 32 <br />The above - mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle <br />map(s): Stony Ridge. <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
