COLORADO Division of Reclamation, Mining and Safety Department of Natural Resources 1313 Sherman Street, Room 215 Denver, CO 80203 May 16, 2014 Jim Wilkinson U.S. Bureau of Land Management Colorado River Valley Field Office 2300 River Frontage Road Silt, CO 81652 Re: North Thompson Creek Mine (Permit No. C- 1981 -025) Technical Revision No. 28 (TR -28) Pond 9 Spillway Design Dear Mr. Wilkinson: The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on May 16, 2014 an application to revise coal mining operations at the North Thompson Creek Mine was considered complete for the purposes of filing. The revision was submitted by MINREC, Inc. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. TR -28 is being submitted as one of the requirements for the abatement of Violation no. CV -2014- 001. The violation was issued to MINREC Inc. on May 8, 2014 because the primary and emergency spillways for Pond 9 were not operating as designed (see April 23, 2014 inspection report). TR -28 proposes a new Pond 9 primary and emergency spillway design. The applicant is not proposing additional surface disturbance outside of the area currently approved for disturbance. The underground coal mining operation is on land located approximately 10 miles Southwest of Carbondale, Colorado.
