Musick, Environmental Protection Specialist
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, Colorado 80203
Re: Peabody Sage Creek Mine (Permit No. C- 2009 -087)
Permit Revision Application No. 1
Dear Mr. Musick:
RECEIVEp
MAY 08 2014
noN
*fe*
The Division of Water Resources has reviewed the Peabody Sage Creek Mine Permit
Revision Application. The applicant proposes development of panels for longwall mining which
will require an expansion to the existing approved permit area boundary. No additional surface
facilities are included in this revision. Mining activities may result in underground dewatering
activities and extension of mine ventilation and support systems. The mining operation is
located approximately 9 miles Southeast of Hayden in Routt County. The State Engineers
Office (SEO) offers the following comments on this project:
The 2013 Annual Reclamation Report indicates that approximately 13 stock water ponds
are present on the site. If the applicant intends to make these structures permanent, this office
recommends that they file for water rights on the structures and complete applications for
Livestock Water Tanks, through the SEO, where applicable. Currently, the stream system in
this location is not overappropriated, however, if the stream system at this location becomes
overappropriated, the storage and use of any surface water will be subject to administration.
Lastly, if construction or operation activities of this project affect the flow of a stream or
ditch we recommend that the applicants consult with the local Water Commissioner. The local
Water Commissioner is Brian Romig and may be reached at Brian. Romig @state.co.us.
Thank you for the opportunity to comment on this project. If you have any questions,
please contact me at this office.
Since ly, --
Ivan Franco
Water Resource Engineer
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 303.866.2223 www.water.state.co.us
