Box 808 <br />Silt, CO 81652 <br />Re: Apex Mine Site, Reference No. M- 2014 -011, <br />Questionnaire, Permit Required - -- <br />Dear Mr. Strong: <br />Division Response to "Is It Mining ?" <br />On April 10, 2014 the Division of Reclamation, Mining, and Safety (Division) received a response to <br />an "Is It Mining" questionnaire regarding a planned project in Garfield County, Colorado on forest <br />service property referenced above. <br />Strong Mining responses indicates plans to do rehabilitation work on an existing portal, replace <br />mine timbers, clear trails and roads to mine, and excavate zinc bearing ores for testing and sales. <br />Based on the information supplied it is the Division's opinion that a mining permit is <br />required as proposed activities fall under the definitions of the Act and Rule as follows: <br />• §34 -32- 103(8) C.R.S. which states: "A mining operation" means the development or <br />extraction of a mineral from its natural occurrences on affected lands. <br />Rule 1.1(31): "Mining Operation" means the development or extraction of a mineral from <br />its natural occurrences on affected land. The term includes, but is not limited to, open <br />mining, in situ mining, in situ leach mining, surface operations and the disposal of refuse <br />from underground mining, in situ mining, and in situ leach mining. The term also includes <br />the following operations on affected lands: Transportation; concentrating; milling; <br />evaporation; and other processing. The term does not include: The exploration and <br />extraction of natural petroleum in a liquid or gaseous state by means of wells or pipe; the <br />development or extraction of coal; the extraction of geothermal resources; smelting, <br />refining, cleaning, preparation, transportation, and other off -site operations not conducted <br />on affected land; or extraction of construction material where there is no development or <br />extraction of any construction material as that term is defined in §34- 32.5- 103(3), C.R.S. <br />Strong Mining is proposing to develop or extract minerals (zinc), although in small quantities where <br />it is naturally occurring.
