Revoked Permit No. C- 1981 -017 (SL -2), DRMS <br />Proposed Decision and Findings Dated February 14, 2014 <br />Dear Mr. Berry, <br />This letter acknowledges the Office of Surface Mining Reclamation and Enforcement ( OSMRE), Denver <br />Field Division's (DFD) receipt and review of the above Termination of Jurisdiction (TOJ) document <br />prepared by the Division of Reclamation Mining and Safety (DRMS) dated February 14, 2014. The <br />revoked permit for the Coal Basin Mine site encompassed 10,981 acres, approximately 310 of which were <br />disturbed by underground coal mining activities. DRMS reclaimed the site in phases between 1994 and <br />2001 using all funds acquired through Mid Continent Resources' bankruptcy proceeding (the forfeited <br />performance bond) as well as additional funds from Non -Point Source grants awarded by the Colorado <br />Water Quality Control Division and federal Abandoned Mine Land reclamation funds. All available <br />funding was expended to complete the reclamation plan for this site. <br />DRMS has monitored the reclamation at Coal Basin for over ten years and conducted a final site <br />inspection on July 23, 2013. Two representatives from the US Forest Service (USFS) attended this <br />inspection. The Bureau of Land Management (BLM) did not attend this inspection. By letter dated March <br />5, 2014, the BLM provided its concurrence with DRMS's Proposed Decision to terminate jurisdiction. By <br />letter dated March 12, 2014, the USFS provided its concurrence with DRMS's Proposed Decision to <br />terminate jurisdiction. <br />This Termination of Jurisdiction applies to all remaining portions of the Coal Basin Mine bond forfeiture <br />site. OSMRE agrees with DRMS's decision to terminate jurisdiction at Coal Basin and hereby provides <br />its concurrence with this action. <br />Thank you and your staff for coordinating this Federal mine termination of jurisdiction action through the <br />DFB.
