energy fuels coal, inc. <br />southfield mine • post office box 459 • florence, colorado 81226 • (719) 784 -6395 <br />February 28, 2014 <br />RFc'elvE <br />Mr. Rob Zuber — Reclamation Specialist L) <br />Division of Reclamation Mining & Safety MAR 0 072014 <br />1313 Sherman Ave — Room 215 OF <br />Denver, CO 80203 M�N�NGD S TIoN <br />RE: Southfield Loadout Sites — Trespassers Illegal Dumping <br />Energy Fuels Coal, Inc., (EFCI) — Permit No. C -81 -014 <br />Dear Rob Zuber: <br />This letter, attached photos and location maps (2) are in response to DRMS' monthly <br />reports reporting of trash and debris at the Southfield Loadout sites located one mile west of the <br />town of Florence, Colorado. <br />The attached photos and location maps depict numerous sites of illegal dumping of debris <br />and trash that are located in the surrounding area of the Southfield Loadout site. The illegal <br />dumping occurs along and/or adjacent to County Road 79 as well as within the Southfield <br />Loadout having been dumped by trespassers. <br />Given that the Rock and Rail Railroad Company holds a lease and Right of Entry through <br />both the East and West Loadout sites whereby the railroad company frequently switches rail cars <br />in and out of both Loadout sites, the entrance gates to both the East and West Loadout sites are <br />continually left open. Trespassers also enter the Loadout sites, have removed No Trespassing <br />signs and painted graffiti on Private Property signs. Previously, trespassers have chopped the 20 <br />foot long wire entrance gate for the West Loadout site into four, 4 foot sections. It is apparent <br />that lacking local enforcement, the surrounding communities have apparently accepted the illegal <br />dumping in this area as being socially acceptable. <br />To date, EFCI has removed from the Loadout sites, cans, bottles, small trash and <br />automobile tires, however, the reported broken concrete debris remains. Given the inability of <br />keeping entrance gates to the Loadout sites closed, as described above and the continued illegal <br />dumping practice in the area, EFC1 should not be liable for the illegal dumping at the Southfield <br />Loadout sites. <br />If you have any questions or need additional information please contact me. <br />Sincerely, <br />George V Patterson <br />Energy Fuels Coal, Inc. <br />
