Matt <br />Carnahan of Four Comers Materials, Kate Pickford from your office, and water commissioner Jeff Titus (DWR) <br />accompanied me on the site visit. Prior to the site visit, I reviewed the information that you provided to our office, <br />including the "Animas Glacier Gravel Pit Drainage Report - Amendment 1" prepared by Russell Planning and <br />Engineering. Based on observations made during the site visit and the drainage report, it is my conclusion that <br />the isolation berm does not present a dam safety hazard if the mining operations are conducted as described in <br />the report, and as such will not be regulated by this office as a jurisdictional dam. <br />The basis for the above conclusion is that the tributary area above the berm is not large enough to generate <br />sufficient run -off such that the berm would create an impoundment of any significance. The drainage report <br />indicates that no process water will be pumped, diverted or otherwise routed to the basin and that the sole source <br />of water will be run -off. During the site visit, Mr. Carnahan confirmed that this is consistent with how Four Corners <br />Materials will operate the facility. He indicated that washing operations utilizing the on -site well water will not be <br />conducted within the basin created by the isolation berm, and the sole purpose of the isolation berm is to ensure <br />that the mining operation will be a zero - discharge facility. In the event that Four Comers does not operate the <br />facility as described, the Dam Safety Branch would consider this a jurisdictional dam and regulate the structure. <br />Thank you for bringing this matter to our attention. We appreciate being notified whenever there is a potential dam <br />safety issue.
