Boulay Division of Reclamation, Mining & Safety Department of Natural Resources 101 South P, Suite 101 Grand Junction, CO 81501 7 Re: Roadside Portals Mine (Permit No. C- 1981 -041) MAR Objection Letter to Bond Release Application SL -8 Dear Mr. Boulay: I have additional data/concerns regarding the statements in the objection letter that I would like to provide while you are conducting your review of the SL -8 surety release application. I have documentation confirming that I was paid to remediate subsidence features. While subsidence features routinely occur in areas where underground mining occurs, the change in this specific hydrology makes irrigation very difficult/wasteful. I've also found that there may be documentation of parcels in the area being restricted as "unbuild- able" because of the subsidence features. (I am trying to get copies of this documentation.) This has a direct monetary affect on land owners. I will plan to take baseline readings at the water discharge meter from the mine, and monitor output changes as I attempt to irrigate my land in the 2W and 3W area. Again, subsidence is not uncommon, but this dramatic change in hydrology is not acceptable or normal. I have concerns over the liability of the discharge from the mine. In the long term, who will be responsible for monitoring, filtering, cleaning, and/or remediating further damage caused by an anticipated increase in discharge. Will the Division of Reclamation, Mining, and Safety? Is this the domain of the Health Department? Again, the current levels of output probably do not elicit concern, but the anticipated increase in output due to agricultural irrigation will cause problems.
