AFFIDAVIT OF PUBLICATION STEAMBOAT PILOT & TODAY STATE OF COLORADO COUNTY OF ROUTT I, Virginia Everard, do solemnly swear that I am Legal Notice Representative of theSteamboat Pilot & Today, that the same is a daily newspaper printed, in whole or in part, and published in the County of Routt, State of Colorado, and has a general circulation therein; that said newspaper has been published continuously and uninterruptedly in said County of Routt for a period of more than fifty -two weeks prior to the first publication of the annexed legal notice or advertisement; that said newspaper has been admitted to the United States mails as second -class matter under the provisions of the Act of March 3, 1879, or any amendments thereof, and that said newspaper is a daily newspaper duly qualified for publishing legal notices and advertisements within the meaning of the laws of the State of Colorado. C214 IRM, Public 13586 -2 NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Min- ing and Safety proposes to Approve Permit Renewal Application No. 4 (RN-4), submitted by Hayden Gulch Terminal, LLC for a coal mining permit at the Hayden Gulch Loadout (Permit No. C- 1992 -OB1). The proposed re- newel will allow for continued miring and /or reclamation operations at the site. The Hayden Gulch Loadout is a/an Loadout operation located in Routt County, approxi- mately 2 miles Southeast of Hayden, Colo- rado. Coal interest is Federal, state and pri- vate, and the solace to be affected is State and private land. The permit area encom- passes approximately 391.20 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34 33 101 at seq., C.R.S., and the regulations promulgated thereunder. A copy of the 'Proposed Decision and Find- ings of Compliance', including any stipula- tions, is on file for public inspection at the Colorado Division of Reclamation, Miring and Safety, Room 215 Centemial Building, 1313 Sherman Street, Denver, Colorado 8W03, and at the Routt County Clerk's Of- fice, P.O. Box 773598, Steamboat Springs, CO 80477.
