The Division of Reclamation, Mining and Safety (DRMS) must assess the status <br />of compliance at the mine site relative to the allegations made in the attached letter from Ms. Turner. The compliance <br />assessment will be done in the context of any requirements found in the Law, Regulations and New Horizon Mine <br />Permit. <br />The letter was also addressed to the Office of Surface Mining (OSM). DRMS has advised OSM that the DRMS is <br />investigating the complaint, and that DRMS will both respond to Ms. Turner and notify OSM of our findings. <br />Please review the complaint and provide a detailed response. <br />Please specifically describe those areas within the WFC permit area where hay crops are produced and managed for <br />harvest. Provide the names of the landowners and individuals involved in such hay production and harvest. Any relevant <br />lease provisions regarding the timing and conduct of these production and harvest activities will also be helpful. <br />Please describe in detail the current and planned status of such production and harvest activities. Please also describe <br />the current and planned status of any required vegetation sampling on these areas. <br />Thank you for your prompt attention to this matter. <br />David Berry <br />
