Rd. 21 Loretta Pineda <br />Haxtun, CO 80731 Director <br />RE: Dumb and Dumber Trucking, Inc., Barton Pit, File No. M- 2000 -149 <br />110c to 112c Permit Conversion (CN -01) Application Second Adequacy Review <br />Dear Mr. Schafer, <br />The Division of Reclamation, Mining and Safety (Division) has reviewed the content of the <br />adequacy response dated December 1, 2013 for the Dumb and Dumber Trucking, Inc. 110c to <br />112c permit conversion application for the Barton Pit, File No. M- 2000 -149, and submits the <br />following comments. The Division is required to make an approval or denial decision no later <br />than December 15, 2013 therefore; a response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.2 (e), please submit proof of the notice to all owners of record of <br />surface and mineral rights of the affected land and the owners of record of all land surface <br />within 200 feet of the boundary of the affected land including all easement holders located <br />on the affected land and within 200 feet of the boundary of the affected land. Proof of <br />notice may be return receipts of a Certified Mailing or by proof of personal service. <br />a. Please provide proof of notice to Logan County Department of Road and Bridge for <br />County Road 10. <br />6.4.3 Exhibit C - Pre - mining and Mining Plan Map(s) of Affected Lands <br />2. Rule 6.4.3(8) requires the Applicant to show the owner's name, type of structures, and <br />location of all significant, valuable, and permanent man -made structures contained on the <br />area of affected land and within two hundred (200) feet of the affected land. <br />a. Please update Exhibit C to indicate the fences owned by Tyler Barton and the <br />overhead power line owned by Highline Electric Association. <br />b.
