During this time Asphalt Specialties was mining <br />at 1201h and Brighton Road while other mining was being done at 1201h and Highway 85. At the <br />end of 2009 it was determined that Asphalt Specialties did not get their backfill material <br />approved through the Mining Commission. I was informed that Asphalt Specialties was ordered <br />to construct a french drain around the mining site to aid in the mounding water issues. To date, I <br />believe the order to install the drain has been ignored and the company has attempted to address <br />the issue with the construction of a trench, which has seemed to alleviate the issue for some <br />time. However, on September 12, 2013 I have again been experiencing severe flooding in my <br />basement and have been pumping water from that date forward. I am aware that we experienced <br />severe flooding in Colorado during this time and would expect to have had to pump some water <br />accordingly, however I do not believe that I should have had to pump water for such an extended <br />period of time. It is my belief that the mounding water issues are due to the french drain not <br />being constructed. I also believe that the water tables have risen as the pumping at 1201h and <br />Highway 85 has ceased. <br />This mounding water issue needs immediate attention and is creating undue financial burdens in <br />labor, material and utility expenses. It is apparent that the trench alone is not resolving the issue. <br />I would like to understand what timeline has been implemented for the installation of the french <br />drain as understood to be ordered by the State of Colorado. <br />Resp tf illy subm' ed, <br />t f <br />Kirk Kirby <br />
