The Division is required to make an approval or denial decision no later than <br />November 25, 2013 therefore; a response to the following review concerns should be <br />submitted to the Division as soon as possible. <br />Rule 6.4.4 Exhibit D - Mining Plan <br />2. The response for the existing slope grading is adequate. <br />3. Please update Exhibit C to indicate all adjoining surface owners of record and show the <br />owner's name, type of structures, and location of all significant, valuable, and permanent <br />man -made structures contained on the area of affected land and within two hundred (200) <br />feet of the affected land as required by Rule 6.4.3 (a) and (g). <br />Rule 6.4.7 Exhibit G - Water Information <br />11. The ditch capacity calculations are adequate. <br />16. The response is adequate. The Operator will be required to provide monthly groundwater <br />monitoring data and the trigger level elevations for each location in the annual reports. <br />17. The responses are adequate. <br />Rule 6.4.12 Exhibit L - Reclamation Costs <br />22. The dewatering calculations for the two mining phases are adequate. <br />24. The Division will reply to the letter from the law office of Joseph R.
