The Division of Reclamation, Mining and Safety (Division) has reviewed the content of Loloff
Construction, Inc. adequacy letter response dated October 21, 2013 and submits the following
comments. The Division is required to make an approval or denial decision no later than
November 25, 2013 therefore; a response to the following review concerns should be
submitted to the Division as soon as possible.
Rule 6.4.4 Exhibit D - Mining Plan
2. The response for the existing slope grading is adequate.
3. Please update Exhibit C to indicate all adjoining surface owners of record and show the
owner's name, type of structures, and location of all significant, valuable, and permanent
man -made structures contained on the area of affected land and within two hundred (200)
feet of the affected land as required by Rule 6.4.3 (a) and (g).
Rule 6.4.7 Exhibit G - Water Information
11. The ditch capacity calculations are adequate.
16. The response is adequate. The Operator will be required to provide monthly groundwater
monitoring data and the trigger level elevations for each location in the annual reports.
17. The responses are adequate.
Rule 6.4.12 Exhibit L - Reclamation Costs
22. The dewatering calculations for the two mining phases are adequate.
24. The Division will reply to the letter from the law office of Joseph R. King under separate
cover.
