Please note that your letter was delivered to us on the day of your division's deadline for receiving comments from our <br />office. <br />A search of the Colorado Cultural Resource Inventory database indicated three previously recorded sites within the project area: <br />Site No.: National Register Eligibility: Recording or Assessment Year: <br />5AA48 No assessment given 1969 (recording year) <br />5AA49 No assessment given 1969 (recording year) <br />5AA3602 Officially eligible 2010 (assessment) <br />In addition one previous survey with report number AA.IA.R35 (2010) covered a portion of the permit area. We also recommend <br />comprehensive survey of the project area because of the nature of site 5AA3602. <br />Our files contain incomplete information for this area, as most of Colorado has not been inventoried for cultural resources. As a <br />result, there is the possibility that as yet unidentified cultural resources exist within the proposed permit area. <br />We recommend that previously inventoried officially eligible and no assessment determination sites be avoided. <br />Please note that site 5AA3602 has been recorded as a multi- household habitation Ancestral Puebloan and later Navajo occupied <br />site that was observed with the presence of human bone (cranial fragment and long bone). Should further human remains be <br />discovered during mining activities, the requirements under State law C.R.S. 24 -80 (part 13) apply and must be followed. Under <br />24 -80 -1305 any person who knowingly disturbs or has knowledge that an unmarked human burial is being unlawfully disturbed <br />commits a misdemeanor under state law. <br />Thank you for the opportunity to comment.
